Internet Service Agreement
¿Habla español? Al final de este acuerdo hay un Resumen en español, que explica el arbitraje y cómo rechazarlo dentro de 30 días.
1. About this Agreement
This Agreement is the contract between you and Central Valley Internet LLC ("CVI," "we," "us") for fixed wireless internet service in Los Banos, Dos Palos and nearby areas in California. It covers both residential and small-business customers. Where a rule applies to only one of them, we say so.
- Who we are: Central Valley Internet LLC, 110 W G Street Unit B, Los Banos, CA 93635 · 209-519-5055 · CVI@centralvalleynet.com · centralvalleynet.com
- How you accept it: you accept this Agreement when you sign up, sign an install order, or use the service. If you do not agree, do not use the service.
- What else is part of it: your order or install form, the Broadband Facts label for your plan (centralvalleynet.com/broadband-facts/), our Network Management Disclosure (centralvalleynet.com/network-management/) and our Privacy Policy (centralvalleynet.com/terms-of-service-and-privacy/). If your order conflicts with this Agreement, your order controls for price and plan only.
- Effective date: for new customers, the date your service is installed. For existing customers, 30 days after we notify you of this Agreement.
- Business customers: "you" means the business and the person who signs up for it. That person confirms they have authority to bind the business.
2. The Service
CVI provides fixed wireless internet: a radio and antenna (the "CPE") mounted on your roof or building links by radio to one of our towers.
- Each plan is rate-limited to its advertised speed tier. Speeds within that tier are best-effort, not guaranteed. Your plan's speeds and latency are on its Broadband Facts label (centralvalleynet.com/broadband-facts/). Actual speeds vary with weather, line of sight (trees, new buildings), radio interference, distance from the tower, network load, your own router and Wi-Fi, and the devices you use.
- No data caps. Every plan includes unlimited data.
- Line of sight can change. If something new blocks the signal, we can re-aim or move your outdoor radio (CPE) for a $100 charge, which we will tell you about before doing the work. If we cannot restore service that meets your plan, either of us may cancel.
- Shared public IP addresses (CGNAT). Depending on your connection, you may have your own public IP address or share one with other customers through carrier-grade NAT (CGNAT). Shared addresses work for normal browsing, streaming, gaming and video calls. They can prevent you from hosting servers, some remote-access tools, port forwarding and some peer-to-peer apps. If you need those, you can buy a static public IP for $15 a month.
- IP addresses are ours. Any IP address we assign stays CVI's property and may change, unless you are paying for a static IP.
- No telephone or 911 service. Internet service from CVI does not include phone or 911 service. If you use a third-party internet phone service, it will not work during a power or internet outage.
- Your inside network is yours. You are responsible for your own router (unless we provide one), Wi-Fi, devices and their security.
3. Installation and Property Access
By scheduling an install, you give CVI permission to enter your property and mount the CPE on your roof, wall or a mast, and to run a cable into the building.
- Permission to mount. You confirm you own the property or have the owner's written permission. Renters and business tenants must get the landlord's written consent before installation and give us a copy if we ask.
- What install includes. Standard installation is free. It covers mounting the outdoor radio (CPE), up to 100 feet of cable and one entry point. Non-standard work (tall masts, extra cable, special mounts) is quoted in advance and done only with your approval.
- Holes and fasteners. Install requires drilling for mounts and cable entry. We seal penetrations, but we are not responsible for normal mounting marks, or for pre-existing roof damage or defects.
- Safe access. You must give our crew safe access and tell us about hazards (dogs, fragile roofs, hidden wiring). We may decline or stop an install if the site is unsafe.
- Later access. You agree to give us reasonable access to service, repair, upgrade or remove our equipment. We will schedule visits with you, except in an emergency affecting the network.
- Removal. When service ends, we may remove the CPE from your property within 30 days, or ask you to return it (Section 4).
4. Our Equipment
CVI owns the CPE, mounting hardware, cabling to the CPE, power supply (PoE injector), and any router we provide. It stays our property even though it is on your premises.
- Care. Keep the equipment powered and connected. Do not open, move, re-aim, modify or resell it. You are responsible for loss or damage beyond normal wear, including theft, fire and pets. We are responsible for normal wear and for failures not caused by you.
- Lightning and power surges. You are responsible for damage to our equipment caused by lightning, power surges or other electrical events at your property.
- Return at cancellation. When service ends you must, within 30 days, either let us remove the outdoor equipment or return it to our office at 110 W G Street Unit B, Los Banos, together with any indoor equipment we provided.
- Unreturned equipment fee. If the equipment is not returned within 30 days, or we cannot get access to remove it, we will charge $800 for the equipment kit. We will credit this fee back if you return the equipment in working condition within 30 days of the charge.
- Your router. If you use your own router, it must be compatible. We support our equipment up to the point where it connects to your router.
5. Billing and Payment
We bill monthly in advance: each bill covers the coming month of service.
- Due date. Payment is due on the 1st of each month.
- Autopay. You may enroll in automatic payment by card or bank account. We charge the amount shown on your bill on or after the due date. You can turn autopay off at any time by calling or emailing us at least 3 days before the next charge.
- Taxes and government fees. Prices do not include applicable taxes and government-imposed fees, which are added to your bill.
- No late, reconnection or returned-payment fees. We do not charge a late fee, a fee to reconnect suspended service, or a fee for a declined or returned payment.
- Suspension. If your account is 30 days past due, we may suspend service after giving you at least 7 days' notice by text or email. Service is restored once the past-due balance is paid.
- Partial months. Your first bill is prorated from the date your service is installed.
- Billing disputes. If you think a bill is wrong, contact us within 30 days of the bill date. You do not have to pay the disputed amount while we review it, and we will not suspend service over it during the review. Pay the undisputed amount as usual.
- Price changes. We may change prices with at least 30 days' notice (Section 15). Your Broadband Facts label (centralvalleynet.com/broadband-facts/) always shows the current price.
6. Term, Automatic Renewal and Cancellation
Service is month-to-month, with no contract and no early termination fee. It renews automatically each month until you cancel. We will keep charging your payment method each month until you cancel.
California's Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 and following) requires us to tell you the following clearly before you sign up, and to get your consent to it.
- What renews: your internet plan and any add-ons (such as a static IP).
- How much: your plan price plus taxes and fees, as shown on your order and Broadband Facts label.
- How often: every month.
- How long: until you cancel.
- How to cancel:
- Online, by email: email CVI@centralvalleynet.com, or use the "Cancel service" link on our Support page (centralvalleynet.com/support/), which opens a ready-to-send cancellation email. No phone call needed.
- By phone: 209-519-5055, Monday to Friday, 8 a.m. to 5 p.m.
- In person or by mail: 110 W G Street Unit B, Los Banos, CA 93635.
- When cancellation takes effect: at the end of your current paid month. We do not give prorated refunds for the rest of that month. We will confirm your cancellation in writing by email or text.
- No cancellation fee: you can cancel at any time without an early termination fee.
- Discount or save offers: if we offer you a deal when you cancel, you can say no and still cancel right away.
- Price changes on renewal: if the price for your renewing service goes up, we will notify you at least 30 days before the change, along with how to cancel.
- We may cancel with at least 30 days' notice for any lawful reason, or sooner for non-payment (Section 5) or serious violations (Section 7). If we cancel for our own business reasons, we refund any prepaid unused service.
- After cancellation: return equipment within 30 days (Section 4). We send a final bill for any unpaid service and fees.
7. Acceptable Use
Use the service lawfully, and in a way that does not harm our network or other customers. You are responsible for everything done through your connection, including by family, employees, guests and anyone using your Wi-Fi.
You may not use the service to:
- Break the law, including sharing child sexual abuse material, fraud, threats, harassment, or infringing copyrights or trademarks.
- Abuse other people or networks: spam, phishing, malware, denial-of-service attacks, port scanning, or unauthorized access to any system.
- Resell or share it outside your premises. Do not resell, rent or redistribute the service, or extend it to other homes or businesses, without our written permission. A business may provide Wi-Fi to its own guests and customers on its premises.
- Run servers or equipment that harm the network. This includes open mail relays, open proxies, open DNS resolvers, or any device or application that degrades service for others. Ordinary home and small-business use, such as gaming, cameras, VPNs and remote work, is fine. Traffic volume alone is not a violation: plans have no data caps.
- Interfere with our equipment: tampering with the CPE, changing its settings or aiming, or using an IP address we did not assign.
What we do about violations. Usually we contact you first and give you a chance to fix the problem. If there is an immediate threat to the network, other customers or the public, or the law requires it, we may suspend the service, or disconnect the affected device, without notice. We may cancel service for serious or repeated violations.
8. Copyright and Repeat Infringers
CVI respects copyright and follows the Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512).
- Notices we receive. When a copyright owner sends a notice about activity on an IP address we assigned, we forward it to the customer if our records identify the account. Customers may share public IP addresses through carrier-grade NAT (CGNAT). Because these addresses are shared, it may be impossible to identify a single user from an IP address and time. We do not give your name or contact details to the copyright owner unless a court order or subpoena requires it (see our Privacy Policy at centralvalleynet.com/terms-of-service-and-privacy/).
- Repeat infringer policy. In appropriate circumstances, we will terminate the accounts of customers who are repeat infringers:
- First and second valid notices: we forward each notice and ask you to stop.
- Third valid notice within 12 months: we may require you to call us and confirm you have removed the infringing material, and we may limit service until you do.
- Five or more valid notices within 12 months: we may terminate your service.
- Counter-notices. If you believe a notice is mistaken, contact our designated agent and we will tell you how to respond.
- Designated agent. Send copyright notices to: Aron Galli, Central Valley Internet LLC, 110 W G Street Unit B, Los Banos, CA 93635 · CVI@centralvalleynet.com · 209-519-5055. Our agent is registered with the U.S. Copyright Office: DMCA-1082633.
9. Network Management and Open Internet
Each plan is rate-limited to its advertised speed tier, and there are no data caps. Within your plan's speed tier, CVI does not block, throttle or favor lawful internet content, apps, services or devices. We follow California's net neutrality law (SB 822, the California Internet Consumer Protection and Net Neutrality Act of 2018) and publish our practices.
We will not:
- block lawful content, applications, services or non-harmful devices;
- slow down (throttle) lawful traffic beyond your plan's speed tier, or based on its source, destination, content or app;
- accept payment from anyone to prioritize their traffic (paid prioritization);
- exempt particular apps or services from a data allowance (zero-rating). Our plans have no data caps, so there is no allowance to exempt anything from;
- use network management as a way to get around these rules.
Speed tiers. Your plan's speed limit is its advertised download and upload speed (for example, 200/50 Mbps). It applies equally to all traffic on your connection, whatever the content, app or source.
How we handle congestion. Our wireless network has finite capacity on each tower. When a tower or link is congested, speeds may drop for everyone on it. We respond by adding capacity, re-balancing customers between radios and channels, and upgrading equipment. We do not single out particular apps or lawful content.
Security measures. We do not block ports. We may act against traffic that is clearly malicious, such as a denial-of-service attack aimed at our network or customers. Such measures target only the harmful traffic and are not used to limit lawful content.
Details are in our Network Management Disclosure (centralvalleynet.com/network-management/), which includes typical speeds and latency, and in each plan's Broadband Facts label (centralvalleynet.com/broadband-facts/).
10. Outages and Service Credits
We work to keep the service running, but no internet service is uninterrupted. If you lose service, call 209-519-5055 or email CVI@centralvalleynet.com so we can fix it and track the outage.
- Service credits. If your service is completely out for more than 24 consecutive hours because of a problem on our network, and you reported it, we will credit one day of service (your monthly price divided by 30) for each full day it was out. Ask within 30 days of the outage. Credits are applied to a future bill and are not paid in cash.
- No credit for: outages caused by you, your equipment, Wi-Fi or power; refusing us access to fix the problem; scheduled maintenance we told you about; suspension for non-payment or Section 7 violations; or events beyond our control.
- Scheduled maintenance. We try to do maintenance between midnight and 6 a.m., and to give notice of planned work expected to last more than 1 hour.
- Events beyond our control. We are not responsible for interruptions caused by events outside our reasonable control. Examples include severe weather, lightning, fire, flood, earthquake, utility power failures, upstream carrier outages, damage by third parties, government action, labor disputes and epidemics.
11. Text Messages, Calls and Marketing Consent
We text and call customers about their service, and, only if you agree, about offers. You never have to agree to marketing messages to get or keep service.
Service messages. By giving us your phone number for your account, you agree that CVI may call or text that number about your account and service: install scheduling, outage alerts, billing reminders, support tickets and payment confirmations. These may be sent through our customer relationship management (CRM) and texting platform. They are not marketing.
Marketing messages, only with your separate consent. If you check the marketing consent box (or give consent in another clear way), you agree as follows:
"I agree to receive recurring marketing text messages and calls from Central Valley Internet LLC at the number I provided, including messages sent using automated technology and prerecorded or artificial voice calls. Consent is not a condition of purchase. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out or HELP for help. See our Terms and Privacy Policy at centralvalleynet.com/terms-of-service-and-privacy/."
- Frequency: varies; marketing messages are typically no more than 4 per month.
- Opting out: reply STOP (or a similar word like END, CANCEL, UNSUBSCRIBE or QUIT) to any text. You can also tell us in any other reasonable way, such as calling, emailing or telling our staff. We will honor your request promptly, and within the time the law requires. You may receive one text confirming the opt-out.
- Help: reply HELP, or call 209-519-5055.
- Quiet hours: we will not send marketing texts or calls before 8 a.m. or after 9 p.m. your local time.
- Do Not Call: we keep an internal do-not-call list and honor the National Do Not Call Registry for marketing calls, unless you have given us consent or the law otherwise allows.
- Changed number: tell us if you give up or change the number you gave us, so messages do not go to someone else.
- Your mobile data is not shared. We do not share your mobile number or text-message consent with third parties or affiliates for their marketing.
12. Privacy and Law Enforcement Requests
Our Privacy Policy (centralvalleynet.com/terms-of-service-and-privacy/) explains what information we collect and how we use and share it. It is part of this Agreement.
We comply with valid legal process, such as subpoenas, court orders and warrants. We disclose customer information to government agencies only as the law requires or allows, including the California Electronic Communications Privacy Act and the federal Stored Communications Act. We may also disclose information in an emergency involving danger of death or serious physical injury. Where the law allows, we will try to notify you before disclosing your information in response to a civil subpoena.
Customers may share public IP addresses through carrier-grade NAT (CGNAT). Because these addresses are shared, it may be impossible to identify a single user from an IP address and time.
13. Disclaimers, Limits of Liability and Indemnification
Disclaimer. Except as stated in this Agreement and your Broadband Facts label, the service and equipment are provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the service will be uninterrupted, error-free or secure from every threat. Nothing in this Agreement limits any rights you have that cannot be waived under California law.
Limit of liability. To the extent the law allows:
- our total liability to you for any claim about the service is limited to the amount you paid us for service in the 12 months before the claim arose;
- we are not liable for indirect, incidental, special or consequential damages, such as lost profits, lost data or business interruption, even if we were told they were possible.
These limits do not apply to liability for fraud, willful injury, gross negligence, violation of law, personal injury or death caused by us, or damage to your property caused by our crew's negligence during installation or service. They also do not apply to any other liability that California law does not allow us to limit.
Indemnification. You agree to cover CVI's reasonable losses and legal costs from third-party claims that arise from your violation of Section 7 (Acceptable Use) or Section 8 (Copyright), or from content you send through the service. This does not apply to claims caused by our own negligence or misconduct.
14. Resolving Disputes
Most problems can be solved with a phone call, so please contact us first. If that does not work, this section explains how a dispute is resolved. Please read it carefully: it affects your legal rights, including your right to go to court and to join a class action.
- Informal resolution first. Before starting arbitration or a small-claims case, the side with the claim sends the other a written notice describing it and the relief wanted. Send notices to CVI at 110 W G Street Unit B, Los Banos, CA 93635 or CVI@centralvalleynet.com. We will send ours to your account address and email. Both sides then try in good faith to resolve it for 30 days. Statutes of limitation are paused during this period.
- Binding individual arbitration. If the dispute is not resolved, either side may start binding arbitration before the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of going to court. This applies to any dispute about the service, this Agreement, billing, equipment or our marketing, including disputes about whether this section applies. The Federal Arbitration Act governs this section.
- The arbitration takes place in Merced County, California, or by phone or video, or on written submissions only if the claim is $25,000 or less.
- CVI pays all arbitration filing, administrative and arbitrator fees beyond what you would pay to file in court, unless the arbitrator finds your claim frivolous. We will pay our share on time, as California law requires.
- The arbitrator can award the same individual remedies a court could, including attorney fees where a law allows them.
- Small claims carve-out. Either side may instead bring an individual claim in small claims court, as long as it stays there.
- No class actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine claims of more than one customer.
- Public injunctive relief. Nothing in this section stops you from seeking public injunctive relief under California law. Any such claim goes to court, after the individual arbitration is decided.
- Opt out within 30 days. You may reject this arbitration section by sending us a written notice within 30 days after you first accept this Agreement. Send it by mail to the address above or by email to CVI@centralvalleynet.com, with your name, service address and a clear statement that you opt out. Opting out does not affect any other part of this Agreement.
- If part of this section fails. If the class action waiver is found unenforceable for a claim, that claim goes to court, not arbitration. The rest of this section still applies to other claims.
- Future changes. If we change this section, the change will not apply to a dispute already noticed, and you may reject it within 30 days of our notice.
15. Governing Law, Changes and General Terms
- Governing law. California law governs this Agreement, along with applicable federal law, without regard to conflict-of-law rules. Any court case allowed under Section 14 goes in the state or federal courts for Merced County, California.
- Changes to these terms. We may change this Agreement, our prices or our plans by giving you at least 30 days' notice by email, text, a bill message or a notice on our website. If you do not agree to a change, you may cancel before it takes effect, with no early termination fee. If you keep using the service after the change takes effect, you accept it. Changes required by law may take effect sooner.
- Assignment. You may not transfer this Agreement or your account without our written consent. We may assign this Agreement, including your account, deposits and equipment obligations, to an affiliate, or to a buyer or successor if CVI or its network is sold, merged or transferred. If that happens, your plan and price continue under the new provider until changed with 30 days' notice as above.
- Notices to you. We may send notices to the email, phone number (by text) or address on your account. Keep them current. Notices to us go to 110 W G Street Unit B, Los Banos, CA 93635 or CVI@centralvalleynet.com.
- Electronic records. You agree to receive this Agreement, bills and notices electronically. You can ask for a paper copy at any time.
- Whole agreement. This Agreement, together with the documents listed in Section 1, is the entire agreement between us about the service. If any part is unenforceable, the rest still applies.
- No waiver. If we do not enforce a term right away, we can still enforce it later.
- Survival. Sections 4 (equipment return), 5 (amounts owed), 13 (liability) and 14 (disputes) continue after service ends.

CVI does not sell your personal information for money. We do not sell or rent customer lists, and we do not sell your browsing history or network usage data.
Website advertising tools. Our website uses Google Analytics and the Meta (Facebook) pixel to measure visits and the results of our ads. These tools let Google and Meta receive information about your visit, such as pages viewed and whether you submitted a contact form. Under California law, this may count as "sharing" personal information for cross-context behavioral advertising. You can limit it by:
- blocking third-party cookies or turning on tracking protection in your browser;
- using the ad settings in your Google and Meta accounts;
- contacting us at CVI@centralvalleynet.com or 209-519-5055 with any questions.
Our website does not currently respond to Global Privacy Control or Do Not Track browser signals.

Text-message data is never shared for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-message opt-in data and consent are excluded from all the sharing categories above, except our messaging platform, which uses them only to deliver our messages.
6. Law Enforcement and Legal Process
We disclose customer information to government agencies or private parties only when valid legal process requires it, or in a real emergency. We do not hand over information on an informal request.
- California agencies: we respond in line with the California Electronic Communications Privacy Act (CalECPA, Cal. Penal Code § 1546 and following). It generally requires a warrant or other specific legal process before a California government entity can compel electronic communication information from us.
- Federal and other agencies: we respond in line with the federal Stored Communications Act (18 U.S.C. § 2701 and following). The type of process required depends on what is requested: a subpoena for basic subscriber records, a court order for other records, and a warrant for content. CVI does not store the content of your internet traffic.
- Civil subpoenas (for example, from a copyright owner): we disclose only what a valid subpoena or court order requires. Where the law allows, we try to notify you first so you have a chance to object.
- Emergencies: we may disclose information without legal process when we believe in good faith that an emergency involving danger of death or serious physical injury requires it, as the law allows.
- We check every request. We review each one for proper form and scope, and we disclose only what it covers. Where the law allows, we may tell you about the request.
7. How Long We Keep Information
We keep personal information only as long as we need it for the purposes in this policy, or as the law requires, and then delete or de-identify it.
| Data | How long we keep it |
|---|---|
| Account records | Life of the account plus 3 years |
| Billing and payment records | 7 years (tax and accounting records) |
| IP address assignment records | At least 12 months |
| Network and device data (MAC, signal, traffic totals) | 12 months |
| Support tickets, call notes, chat and text transcripts | 3 years |
| Install photos and site records | Life of the account plus 3 years |
| Text and marketing consent and opt-out records | 5 years after your last message or opt-out |
| Website analytics and cookies | 14 months (set in our analytics and advertising tools) |
| Records under a legal hold or active dispute | Until the hold or dispute ends |
Customers may share public IP addresses through carrier-grade NAT (CGNAT). Because these addresses are shared, it may be impossible to identify a single user from an IP address and time.
8. Security
We use reasonable administrative, technical and physical safeguards to protect personal information. They include limiting staff access to people who need it, password and multi-factor protection on our business systems, encryption of payment data by our payment processor, and secured network equipment. No system is perfectly secure. If a breach affects your personal information, we will notify you as California law requires.
You can help by keeping your account login, Wi-Fi password and devices secure.
9. Children's Privacy
Our service and website are for adults. You must be 18 or older to open an account. We do not knowingly collect personal information from children under 13, or sell or share information about anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.
10. Your Choices and Rights
You can ask us to show, correct or delete your personal information, and we will honor reasonable requests. The California Consumer Privacy Act (CCPA) applies only to businesses above certain size thresholds, and may not apply to a company of CVI's size. We follow its main ideas anyway.
- Access: ask what personal information we hold about you and get a copy.
- Correct: ask us to fix anything inaccurate. You can update most account details by calling us.
- Delete: ask us to delete your information. We may keep what we need to finish providing service, collect amounts owed, keep required business and tax records, respond to legal process, or protect our network. While you have active service, we cannot delete what we need to provide it.
- Marketing texts and calls: reply STOP to any text, or tell us in any reasonable way. Service messages about your account continue while you have service.
- Marketing emails: use the unsubscribe link in any email.
- Cookies and advertising: see Section 4. Our website does not respond differently to browser "Do Not Track" signals or to Global Privacy Control signals at this time.
- No discrimination: we will not charge you more or give you worse service for using these rights.
How to make a request. Email CVI@centralvalleynet.com, call 209-519-5055, or visit our office. We will confirm your identity before acting, usually by matching details on your account, and we will respond within 45 days. You may use an authorized agent if we can verify their authority.
11. Changes and Contact
We may update this policy. We will post the new version on this page with a new effective date. If a change materially affects how we use or share your information, we will notify customers at least 30 days in advance by email, text or bill message.
